Article 1/
The present contract is an online sales contract subject to acceptance by FIGHTING FILMS and drawn up in accordance with current French legislation. The purpose of this contract is to sell the products presented on the www.fightingfilms.shop website.
The contract will only be formed between the customer and FIGHTING FILMS upon receipt by the customer of a receipt confirming the details of the order placed on the www.fightingfilms.shop website. The contractual information is presented in French and the products presented for sale comply with French legislation as of September 1, 2013.
Article 2/
Validation of the order by the Customer implies acceptance of these General Terms and Conditions of Sale. The Customer undertakes to pay in full for the products ordered when validating the order. As the sales contract gives rise to an obligation of means on the part of the seller, FIGHTING FILMS undertakes to deliver the items ordered by the Customer to the postal services within the time limits announced when the contract was concluded. However, FIGHTING FILMS reserves the right to cancel any order from a customer with whom there is a dispute concerning the payment of a previous order.
Article 3/
We make every effort to describe and present the products on our website www.fightingfilms.shop as accurately as possible. However, FIGHTING FILMS cannot be held responsible for any errors or omissions in this presentation. Each photo representing our products has been carefully chosen to be as representative as possible. However, these are not part of the contract and are for guidance only.
Article 4
All our product prices are quoted in Euros (€), inclusive of tax (VAT), and exclude shipping and handling charges, which are payable by the customer (except for special promotional offers). They are guaranteed subject to typographical or printing errors. However, FIGHTING FILMS reserves the right to modify its prices at any time, without prior notice and without compensation. In the event of modification, the articles will be invoiced on the basis of the prices in force at the time the order is registered on the www.fightingfilms.shop website and subject to availability.
Article 5
Validation of the order placed by the Customer on the www.fightingfilms.shop website implies acceptance of these General Terms and Conditions of Sale. Once the order has been validated, the invoice is sent to the e-mail address indicated by the Customer when placing the order or registering on the site. It is established in accordance with the price list in force on the day the order is placed. In the event of a material error in the customer’s e-mail address, the customer has a maximum of 24 hours in which to contact customer service to notify them of the error and provide them with their correct contact details. After this period, FIGHTING FILMS cannot guarantee that the modification will be taken into account.
However, FIGHTING FILMS reserves the right to refuse any order from a Customer with whom there is a dispute or incident relating to the payment of a previous order or justified by the present General Conditions of Sale.
Orders are validated using the “double-click” procedure: after adding the desired products to the shopping basket, the customer is invited to confirm his/her selection once before accessing the payment page, where he/she enters all the information required to pay the requested price, and to validate it a second time. The data recorded by the seller constitutes proof of the nature, date and content of the contract.
Article 6
Accepted means of payment are :
– Payment by PayPal. In this case, the customer is redirected to the PayPal website to make the payment.
– Payment by credit card via PayPlug
Article 7/
Article 8
Although we strive to offer quality products, it may happen that the Customer is not fully satisfied with his/her order and wishes to return it partially or entirely. FIGHTING FILMS wants to be as transparent as possible with its customers and would like to point out that retraction is a right conferred by article L120-20 of the French Consumer Code: “The consumer (here the Customer) has a period of seven clear days to exercise his right of withdrawal. without having to give reasons or pay penalties, with the exception, where applicable, of return costs”. The postmark or the date of the delivery receipt constitutes the starting date of this withdrawal period, and its expiry makes any exchange or refund impossible. Products returned damaged, incomplete or soiled will not be exchanged or refunded.
Article 9
In order to process orders efficiently, it is necessary to collect customers’ personal data. All this personal information will be used solely by FIGHTING FILMS, which hereby undertakes not to distribute it to any third party, with the exception of external service providers who require it for delivery purposes. This information will be included in a confidential file specific to FIGHTING FILMS. In accordance with the French Data Protection Act of January 6, 1978, customers have the right to access, modify and delete their personal data. If the Customer wishes to exercise this right, he/she simply needs to notify FIGHTING FILMS France, indicating his/her last name, first name and address.
Article 10/
All orders placed on the www.fightingfilms.shop website automatically imply the customer’s acceptance of these General Terms and Conditions of Sale, which are governed by French law. In the event of a dispute, the French courts shall have exclusive jurisdiction. In the event of difficulty or complaint regarding an order, it is obviously preferable for the customer to contact customer service in order to find an amicable solution.
